Moses Okon alleged murder case has suffered yet another setback as the trial has been adjourned to May 2024 for “Trial Within Trial.” .
This as the defense council S. Oyewole vehemently opposed the motion brought before the presiding judge, justice S.P Gang sitting at court 4 of Plateau State High Court by law officer with Plateau State Police Command prosecuting counsel to the defense M.M Alex (Mrs),of Court admissibility of the earlier Moses Okon’s confessional statement taken by police during his arrest on the alleged bases that it was written under duress.
The matter at the last adjournment was adjourned to today 18th March, 2024 for continuation of hearing and presentation of more witnesses of more witnesses.
At the continuation of hearing on Monday 18th March 2024, witness (PW6), Assistant Superintendent of police(ASP) Suleiman Zubiru attached to homicide department of Nigeria Police Force (NPF) Plateau State command narrate to the court all he knows about the matter.
Suleiman narrated that on the 17th January 2024,a case of culpable homicide was reported in his office that was transferred from Laranto police station to the police headquarters for an investigation.
He further narrated that he and his immediately swung into action with teams of his police investigators, named polycarp Gana and others head straight to the hotel the alleged incident said to have happened.
He revealed that on getting to the location of the incident which happened at the hotel,one of the receptionist narrated how Mr Moses Oche , who was later identified as Moses Okon checked into one room number 302 of the facility .
After a while when he was about checking out, the receptionist
instructed him to wait at the reception while the receptionist went to check the room to ensure nothing is missing in line with the hotel rules but shocked to discover the lifeless body of a young lady on the floor, lady hand bag which was later identified by the friend of the deceased to have belong to the deceased,a fork spoon , one pair of lady shoe and bedsheet stained with blood.
The witness narrated further that the receptionist gripped with shock and disbelieve, ran out to the reception where he had earlier directed Moses to wait while he go and inspect the room , to discovered that he had ran away without completing the guest form.
ASP Suleiman narrated further that as evidence, his team of investigator and himself video tapped the scene of the crime only for the father of the suspect to appeared at the station the next day to report to the police about the suspect who is his son and the deceased whom he identified as the girlfriend.
At this point the prosecuting counsel M. M Alex who is law officer with the State police command prayed the court to tender the tapped recording of the scene of the incident that had been fashioned into CD plate as evidence to played before the court for explicit explanation by the witness Suleiman Zubiru.
The motion to tender the CD and play it meet with brink stone as counsel to the respondent oyawole vehemently opposed the motion raised by Barrister Alex.
After argument and counter argument between the parties, the presiding judge, Justice S. P Gang rules in favor of the prosecuting counsel representing the commissioner of police plateau State command ,and CD was admitted in evidence and played for the court to see/hear.
The witness continued his narration as it related to the murder case that the suspect Okon who was on the run after the allege crime was however apprehended in Benue state and brought back to jos .
He further narrated that when the victim was brought back to jos, he was taken to the command hospital clinic following the wound he sustained but couldn’t say how the wound come about.
He remained at the hospital for some days before I approached him if he is in good state of mind to take his statement, he obliged me his statement .
At that point the prosecuting counsel M.M Alex move to tender the statement in an evidence and the defendant counsel Oyawole objected to the motion on the ground that it was taken by the police under duress.


The presiding judge justice S.P Gang adjourned the matter to May for trial within trial.
