Appeal court sitting in plateau state Division has vehemently refused the motion of Edward Pwajok (SAN),for an extension of time to file his brief.
As the court remained Edward that although there is nothing wrong in seeking the leave of the court to regularise some abnormalities that could cause impediments capable of destrupting the free flow of legal presentation, but he should know that this is an exceptional case which is pre-election matter which has time frame, better put it, generic.
The chairman of the presiding Judges, Honourable Justice A.A.B Gumel further stressed that the court didn’t have a luxury of time such as motion for the extension of time.
As against this background,Gumel said the court will not hesitate to refuse the motion for extension of time as moved by Edward Pwajok (SAN) to file his brief or any other motion.
It could be recalled that the Court of Appeal on Monday 30th January,2023 heard a pre-election Appeal brought before it by Ambassador Yohana Margif against the Labour Party (LP), Dr. Patrick Dakum and INEC.
Margif approached the Appellant Court following the dismissal of his case at the Federal High Court Jos. The lower court, in addition to holding that Margif voluntarily withdrew from the race based on the documents before it, also placed reliance on a press statement from Mushere Ward of the LP expelling Margif from the party. The lower further held that the Plaintiff (Margif) lacked locus standi to institute the matter in the first place having not participated in the second primary election of 5th August 2022.
When the case was called, Pwajok (SAN) who represented the Governoship candidate of the LP in Plateau State told the court he had two applications filed, one of which was to seek for enlargement of time to file his Brief of Argument adding that all parties in the matter were equally served.
Moving the application, Pwajok SAN said, “My Lords, the first application is dated 16th but filed on 27th January 2023 for enlargement of time.
“The Appellant responded by filing a Counter Affidavit to the motion. Upon being served with with the Appellant’s Counter Affidavit, we filed a reply on point of law dated 22nd January 2023”.
The Learned Silk on behalf of the 2nd Respondent went further to adopt his processes in urging the court to grant the application in the interest of justice.
In his submission, Counsel for the Appellant, Opeyemi George said, “Our Counter Affidavit is dated 20th 2023 and filed the same day accompany with Written Address.
“We adopt same as our position in opposing the application and urge my Lords to dismiss the application in the interest of justice”.
In his ruling, Hon. Justice A.A Gumel who presided over a three-man panel dismissed the application. Justice Gumel further stated that the Panel was a visitation one stressing that such an application was for the Panel of the Jos Division. Justice Gumel however observed that the position of the Learned Silk was well captured in the processes of the 1st Respondent.
Consequent upon the ruling, Pwajok (SAN) applied for the withdrawal of the second Application. With no objection from Counsel for the Appellant, 1st and 3rd Respondents, the application was struck out.
On behalf of the 1st Respondent, G.M Kitty SAN adopted his Brief of Argument saying it was a succinct argument in pursuing the court to see that there existed no meritorious submission for the Appeal to be sustained. Counsel therefore urged the court to dismiss the Appeal with a cost.
Y. A Gutet Counsel for the 3rd Respondent equally adopted his Brief of Argument dated and filed 8th January, 2023 in urging the court to dismiss the Appeal. Justice Gumel reserved judgment saying that the date would be communicated to Counsel in the matter.
The People Redemption Party (PRP), has urged the Appeal Court sitting in Jos Division to ruled that the Independent Electoral Commission (INEC) ,err in law for accepting the name of Senator Bala Mohammed of people Democratic party (PDP),for Governship Candidate in 2023 general election.
This is because the electoral Act of 2022 has made it clear that a candidate can not make double nominations which if it happened, such aspirant/candidate stands disqualify from participating in the election .
The governship candidate of People’s Redemptions Party PRP, in Bauchi State Barrister Ahmed Faruq stated this in an interview with journalists in Jos during the Appeal case challenging the cadidature of Bala Mohammed as the PDP Governorship Candidate for 2023 general election.
Ahmed said the election umpire INEC, err in law to have accepted the name of the former fct Minister, Bala Mohammed as PDP bonafide Governship Candidate because it grossly violates the 2022 Electoral Act and the constitution of federal Republic of Nigeria .
He said the 2022 electoral Act signed into law came into effect, and is going to be use in 2023 elections and the law will be adhered to and put in cognizance when prosecuting all electoral matters.
We are are challenging the nomination of PDP and other accusations , it’s with the knowledge of everybody that PDP candidate Bala Mohammed contested for presidential election, when he lost, he came back asked the candidate of the party to withdraw his candidacy and was replaced by him.
He said the action of the candidate who is a sitting governor of the state,is a fragrant violation of electoral Act Section (115D),which states it clear that nobody is allowed to contest in two office in one election .
PRP Governship Candidate In Bauchi State.
He further stressed that the office of President and that of the governor are two different election which is a circle of 2023 general election which go against the letters and spirit of electoral Act of 2022.
And debunked the insinuations that the matter is Internal affairs of the party, adding that if the issue is Internal affairs of the party ,the electoral Act wouldn’t have speak about it in the first instance.
So we are challenging INEC for accepting , and publishing the name of Governor Bala Mohammed in it portal as the party candidate.
We are not member of the party PDP, because is their Internal affairs, because Section 115D, of the electoral Act is very explicit in that,so that is why we are in court for interpretations.
He added that People Redemption Party PRP is not new politically, as the party contested and won federal House of Representatives in 2019 in Bauchi State and asked anybody who cares to know more about the party,it acceptance in the state to go and conduct independent investigation.
Ahmed who is a lawyer by profession , said as Minister in the temple of Justice ,we actually help to deepen the law ,is not about personal interest ,we are helping the Judiciary to develop the law.
He called on the supporters of PRP to look out for people with credibility that they should not vote along Party line, sentiments but should look at the quality of candidates before they vote for the person.
Even the president who was ones a proponent of “Sack” has even change his word directing people to vote according to their conscience, vote for the people that can do the job, not the people the job can do them.
He said the All Progressive Congress (APC),in the state is also having similar challenges of double nominations but the Deputy governor of the party in the state ,Shehu Aliyu was nominated to contest as a member House of Representatives, and also for the position of Deputy Governor.
And argued that his nomination fall short of the 2022 electoral Act ,as his nomination as Deputy Governor was not affirm which is the New innovation in the electoral Act.
” That every nomination that is not elected office , that nomination most be rectified by member of the party. We felt INEC having been empowered by the New electoral Act, should have scrutinised these candidates and their activities ,and where they run fowl of the law , they should not have publish their names.”
We are telling INEC that is not what was envisage in 2022 electoral Act. Act.

“In line with this, thorough investigation was carried out following the illegal activities of the above men to damage and destroy the party through its activities in view that the national elections is few weeks away.”
The party structure has taken a decisive step to rescue the party from total collapse and having constituted a three-man fact-finding committee to look into the allegations with a view to determining the veracity of the claims.
The Committee submitted it’s report which findings clearly showing that prof Danladi Atu has been working against the interest of the party in the state leading to his expulsion while Rufus Bature is suspended for three months.
